A federal judge ruled yesterday that the federal government’s ongoing deployment of National Guard troops in the District is illegal, granting the District’s request for a preliminary injunction but also issuing a 21-day stay to give the Trump administration time to appeal.
DC Attorney General Brian Schwalb — who filed suit soon after President Donald Trump deployed the DC National Guard and asked states to send troops as well — hailed the decision by U.S. District Court Judge Jia Cobb.
“From the beginning, we made clear that the U.S. military should not be policing American citizens on American soil,” Schwalb said in a statement that warned against the use of troops for domestic law enforcement. “This unprecedented federal overreach is not normal, or legal. It is long past time to let the National Guard go home — to their everyday lives, their regular jobs, their families, and their children.”
White House officials contend that Trump has not exceeded his legal authority and continue to blast DC’s lawsuit as undermining a successful operation to fight crime. It’s unclear whether they’ll file an appeal, however.
On social media, Schwalb’s efforts won quick praise from several DC officials and political candidates.
